DMCA Copyright Policy

1. Overview
EnviroCheck (“we,” “us,” or “our”) respects the intellectual property rights of others and expects users of our website to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), 17 U.S.C. § 512, we will respond promptly to claims of copyright infringement committed using our service.
Please note that this Site aggregates publicly available environmental data from U.S. government agencies including the EPA and FEMA. Such government data is in the public domain and is not subject to copyright protection under 17 U.S.C. § 105.
2. DMCA Takedown Notice
If you believe that content available on our Site infringes your copyright, please submit a written notification containing the following information:
- A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
- Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved.
- Identification of the material that is claimed to be infringing, including its URL or other specific location on the Site.
- Your contact information, including address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.

4. Counter-Notification
If you believe that the material removed (or to which access was disabled) is not infringing, or that you have authorization to use it, you may submit a counter-notification containing:
- Your physical or electronic signature.
- Identification of the material that was removed and its prior location on the Site.
- A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification.
- Your name, address, and telephone number, along with a statement that you consent to the jurisdiction of the federal district court in your judicial district and that you will accept service of process from the person who filed the original DMCA notification.
Upon receiving a valid counter-notification, we may restore the removed material in accordance with the DMCA.
5. Repeat Infringers
In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers.
6. Good Faith
Warning: Filing a DMCA takedown notice or counter-notification containing materially false information may subject you to liability for damages, including costs and attorney's fees (17 U.S.C. § 512(f)). Please consult legal counsel before submitting a notice.
